Proximity to decision making or prolixity of laws?

Before a law is passed in Ireland it has to be unanimously approved by the Council of State and remains cocooned like a boast in an oyster until that juncture. If it is not so approved,the President is morally and legally obliged to refer it to the Supreme Court to test its legality. The same is the case with the European Union.

In Britain we have a Spanish 'camarilla' or a plant with roots (not the police 'plant' who comes to your home to infer that you are the police source,not him). In Britain,the Privy Council is consulted by the head of state but the sovereign power has no power to approve or disapprove enactments or controvert regulations which infringe long-standing legal rights granted by the Constitution,a system which is built on checks and balances on those in positions of power. That is the role of the House of Lords Judicial Committee which can only strike down a law where a substantive breach of rights or obligations or pre-existing laws relating to the Constitution has taken place.

A call for the re-examination of the standard of degrees awarded by the self-perpetuating elite at Queen's University,Belfast

 In my judgement and contemporary experience bears this out, Queen's University deliberately humiliated and systematically degraded generations of Catholic working class students and destroyed their lives, depriving them of their cherished career choices.

I am thinking of wordy buffoons such as Barry Malcolm,Colin Campbell,Herby Wallace,Brian Childs and Brice Dickson. As for the female tutors in my university years,they hadn't a clue about what they were talking. They were playing silly games to curry favour with university authorities and the unionist politicians at whose initiative their posts were awarded.

My studied observation is what it was then. In controversial fields,the unionist bimbos and Castle Catholics were given preferential treatment. I am thinking in particular of people in my echelon such as Rafferty,Walsh, Doran and Larkin.

The record is clear. It could not be clearer. The dunces and know-nothin's with no glowing academic records before their admission to the Law Faculty were given 'top marks' for bland ignorance of their chosen field. Call-girls graduated with superior 'qualifications'.

With hindsight,my concerns are somewhat frivolous. Times have moved on. Pro- British Interlopers and wall-flowers who discriminated on political,social,religious and national grounds must go in the next couple of years and leave our shores. They, like other university lecturers and professors, have overstayed their welcome. There can be no reconciliation between Gael and Gall. The problems have been here for generations,if not centuries. I say to strangers and collaborators,"GO! AND GO NOW!"

Queen's University represented an evil cradling for Ulster Unionism. That way of life was based on high expectations for Catholics and,for me,negligible outcomes, attrition and entrapment in pseudo-gang activities played out by pawns of the Southern Government such as Aidan Donaldson and Paddy Mc Dermott and Michael Farrell and sundry others on the Irish Secret Service list of paid agents in the North.

Queen's degrees are not very highly regarded outside Northern Ireland because the lecturers are all Protestant. They are told by their superiors to mark down the astute and gifted because it is a clash of opposites. The best students are Catholics not those scoring high marks. All top lecturers receive money from the police for information and the police are particularly interested in humiliating Catholic students. An educated person is the only person who can get the better of a policeman unless he is a medical student. The latter are brought up to obey the police. Trinity is the same as Queen's in the South. Protestant students are given the best degrees there but very few of them ever get work or are gainfully employed after their time at Trinity. UCD graduates hold a monopoly on salaried employment in the South.

Every trade union has its police liaison officer because that's how most trade union officials find out about labour discontent and threatened strikes. They do not hesitate to have people arrested but they push a woman in to the frontline to take the blame for their activities. Their only God is some obscure group with about ten or fifteen members.

Like all women who give confidential information to the police,Brid Maloney is a rough,ignorant woman who trails through the streets after men rifting and farting in public.

Avoid! Have nothing to do with the IRA or Sinn Fein or PBP or Socialist Party. They are the so-called political groups who procure informants for the police and that is invariably the road to ruin for most people who are not lawyers or doctors or officials of the Government.

In Ireland ,a political false trader......

...such as a Communist or revolutionary socialist or Provo agitator will find it hard to contain his hatred of yourself when he is amongst his real friends. (They have created and built nothing in this country. Their plans exist only on paper.) He knows who his friends are and when it is safe to attack. In Ireland that is some tiny group which comprises no more than ten or twelve people offering the "three steps to heaven".

By the time of his profession du foi,he will already know that he and his group,both,are  irrelevant and destined for obscurity and that his cause and theirs are lost.

If he shows open contempt to someone who is or was a great man in some way-greatness is easily borne and never speaks its name in our wicked colony -he thought that that person would rescue his situation. 

That 'saviour'  realised early that he was either an unblemished thug such as O Riordain or a paid police informer such as O Murchu or a dangerous nuisance such as Mc Cartan.

In his final moments,even this self-styled revolutionary philosopher will realise that Christian charity is the one and only characteristic of greatness and mankind's sole redeeming grace which sets him apart from other creatures.

Politicians and truth

If a politician insults you in public,that is his true voice like the rising falsetto of a Thatcherite scream. He values only his public image. That is why he is drawn to public life and human intercourse.

A sectarian politician only cares about his public image and his standing in the community. If a (leftist) guru insults you in front of his soulmates,it is because he finds you an obstacle to his ascent to power. If he is an Irish revolutionary socialist or Provo type or armed man,he equates a great man with a religious  philosopher and bon litterateur. 

If you are treated in this fashion by a politician or other person or a Provo,turn your face against him or her and have nothing more to do with him. His mien is a sign that he fears rejection at the polls. 

Alternatively,his or her career before the electorate may have run its course and new contenders have emerged to hoodwink, cajole and mislead the public on behalf of Irish revolutionary causes. The portents can be read easily by cognoscenti. 

Politics are in Ireland extensions of the art of subterfuge and contrarian thinking, political upset and revolutionary ideaisation.

Those people are the road to no town and products of a grossly impaired and deficient education system or the indulgence of a literary editor who doesn't know what he is talking about.

Eoin O Murchu and Eugene Mc Cartan both work with the Government to keep the unemployed under control. He lives up by the Phoenix Park in a big house which he owns,him and him alone. Both that pair and O Riordain were paid informers with large properties and hidden assets and undeclared earnings."

A foolhardy litigant

When you go to law,it is extremely foolish to take strangers into your confidence in pubs,bars and restaurants. On the contrary, what is said in your own home and to family and friends about a legal action rarely travels beyond your four walls.

When you go to law,never confide in a politician and political figure such as an election canvasser. He will put it around that you are "a suspicious character"(Lenin) or that "you had problems long before you came to us" (Sean Lynch,Sinn Fein).

Having accessed the legal system,you will be the toast of the poor and down-at-heel and the butt of ridicule of those wayfaring strangers, people carrying knives and guns and those who have carried them.

When you go to law,it does to remember.....

.....if a politician or lawyer or doctor,priest or professor think that a litigant is insane,they will soon speak their part. If they think that he is a threat to their safety or if they have stolen from him or had him arrested or had him beaten up or if they have been judged by their superiors to have unfairly maligned him while in public office without his knowledge,not only will they not come into his dwelling but they will not allow him onto their premises or into what they tell people is 'their' office.

Why?

They owe him money. Often indigence is the cause of their victim's fall from grace. They have stolen his wages or profited illegally from him in some other way. Money is as Marx said,the Universal Equivalent but you may not be paid your wages  if you are a rich man's foil. He has many little helpers but every conman and shyster is eventually brought to court and told to pay back what he stole. Only rarely does a thief escape retribution.

 We count amongst the aforementioned politicians and gamblers Sean Lynch,Sean Quinn, Dobryulubov in Russia and Martin Hayes in Dublin. 

The Senegalese and hated pieds noirs are allocated the roles of these mouchards in Paris and immigrants are allocated the roles of the so-called Spitzeln in Germany. 

Here in most cases, IRA men 'divided up Jesus's garments and possessions after casting lots for his cloak'.

The Biblical example is played out by the victim's playmates. Those he had engaged with may they have been prince or pauper but the injured party will have been told where his quarry lived.

My fall from grace was for engaging with my enemies,namely republicans and Communists and revolutionary socialists. Their  sponsor,the Irish Army,was the cause of not just my own but my family's ruin. My friends are nationalists, though not of the insurrectionist type.

The latter had not the slightest aptitude for real knowledge or for any proper acceptance of the Christian faith's vibrant existence. It was the revival of militant syndicalism and Russian Orthodoxy which unseated Gorbachev and got rid of the Communist Party of the Soviet Union long after I exposed him for escamotage. 

There was much long and varied debate within the Soviet Union, particularly during the latter years of his presidency.

 Gorbachev remains an unrepentant Marxist to this day. Anything he owns was stolen or plundered from real politicians and serious thinkers who do not indulge themselves with matters of state in large countries. (The Soviet Union and US both have too many problems for one person to deal with alone. Advice and assistance is always necessary.)

 In this connection of escamotage,my philosophy.Revolution or reform?

Incremental change as represented by an unfolding court submission has the potential to return back to its owner stolen property and the fruits of knowledge i.e. intellectual ideas. Never dramatic change in the sense of a derogatory remark or a police investigation. Rush to judgement in public  interest cases may be a sign of panic and incipient public disorder, not a democratic revolution of either the Eastern or Western type.

The hope of this sideshot at Gorbachev is this proverbial insight,

Some advice when you have a case before the courts 

"Don't talk to people who insult you or openly denigrate you and mock your achievements and views because they are trying to undermine your morale and soften you up for even more blows to 'the body,the head,the chest'. Those people do that to everyone who goes to law and hasn't  the mentality of a slave in the Deep South. Keep to what you know. Have a few close friends after you initiate legal proceedings against a lawyer,businessman or judge such as a doctor. Don't expect any help from cornerboys or other latchikos who go into public houses and keep your business out of the gaze of politicians. Make sure your confidantes are people who you trust and when you have had a measure of success at your legal endeavour or some other undertaking,your real friends and others will flock to your funeral when you die. Keep your family at arm's length when you get older but give them as much of your money as you can if they have children and you don't.

"A b...... who intends to betray you will always ring you up rather than visiting you on his own and he will always act under false pretences to discuss the affairs of the day at the weekend and thereby gain information which he intends to use against you in the  course of the following week. He will report you to the police very soon afterwards also because police stations are very quiet at the weekend. Remember too that an informer will always approach you where meals are being served. His aim is to drive away your real friends and isolate you from those who want to come to your assistance.

If a lawyer or judge is unsure of certain facts in a difficult or long running case for ultimate decision making at his volition,he may send what is known as a court rapporteur.

That is not the case in Ireland because a judge is ultimately answerable to other legal headmen in a foreign country,namely Britain.

Here in the inquisitorial style,it is the person who is contemplating legal action against you who sends someone to strip you of family and social supports and deny you any comfort. Listen to that person often enough and he will give the game away,even telling you the plot ending. His own taste is for drama and personal revenge for an imagined wrong not justice and law.

It is the British police and outside prosecutors and those intent on denying the prisoner his release or the oppressor who will not remit the captive's sentence who rather send a court rapporteur to someone's door or act through a third party.

In law,this is may, subject to legal proceedings,be known as perverting the course of justice,attrition or Abbruch  (Germ., abortion or sabotage of a legal action for restoration of rights or release from a bond).

How you will know someone has been poisoned with political, religious or sectarian hatred....and....

....by how they vote, anywhere in the world.

How you will know you are dealing with is a nut or neurotic...

You will know if someone is eating LSD in the form of magic mushrooms by the fact that they have a very sensitive nose. That is how most graduates consume drugs, particularly arts and biochemistry graduates.The psychological emendations of LSD should not be confused with cocaine. The outworkings of LSD consumption are "fits of giggles" whereas as police agencies,amateur philosophers and army doctors know,cocaine leads to paranoia...

Doctors lack any interest in people who take drugs voluntarily but in Northern Ireland  their knowledge and sensibilities are often stretched to incredulity by patients who have been arrested. They will have been poisoned by the legions of Escapists,drug dealers and those 'game for a laugh'.

 Amongst the ranks of fools such as theze enlightened.mockers,we count lawyers who sue on behalf of "victims of sexual abuse by priests and teachers'. That sort of know-all is a lunatic who gets lost in bickering with other legal professionals. 

Those people know even less about sound judgement than their opponents do. At the back of these legal proceedings stands an amateur politician or a medical naysayer or a journalistic doom-monger. They are in  equal measure hated and reviled by the Church-going public. Someone who is possessed of good sense never "gets ahead of" average matters, unlike a witless female psychiatrist who puts the litigant up to his antics.

A characterisation of political meddlers,some advice 

Join a democratic party not a cart-load of has-beens and never-weres such as the PBP, Solidarity or Communist Party. They are whingers and whiners who snipe from the sidelines. (If you do join them,you will inevitably end up in outright opposition to such groups and their frontmen. Those groups are fronts for foreign interests with the exception of Sinn Fein. Sinn Fein,too,has lost its sense of political direction because its leadership has its eyes too closely set on lining its own pockets).

We all....

 .....want to get on with one another but sometimes policemens'conduct,often arrogant and high-handed,makes this impossible. A death by misadventure in the family brings it home to you that their existence is no mischance and they are vitally necessary. The actions of some policemen do,however,give very serious cause for concern and I do not just mean whacko weirdo 'born-again' nutcases but Catholic policemen too.

Let the Chief Constable stop engaging in irresponsible posing with armed men and realise that,if I am not mistaken,the democratic basis of the Northern Ireland state disappeared years ago. Catholics are in the majority because of vastly superior moral guidance.

If police and their families do not want to feel the anger saturation policing and blanket policing create,let them examine cause and effect and,while maintaining a regular presence,go into areas only in response to a reported crime or incident.

BUT,above all, the police must STOP impeding the functioning of the courts and system of justice and interference with laws designed to protect the public...

A solicitor and a cherished aim or a false imperative directed at himself?

A solicitor who tells you,"I like to keep my cards very close to my chest" intends to sue you for unpaid fees and time-off to cope with emotional stress which,with fatuous certainty, he claims you have caused him. 

In actual fact,he isn't up to the job and is not suited to legal practice-he should never have been allowed to perform any task other than legal clerk-or he has settled out of court for less than the desired amount for quick payment since he has large unpaid bills and debt collectors are "about to break down his doors". He has "left you in the lurch to sort out your own mess". You will know that he has invested your money in non- performing investments or bankrupt firms by the fact that he will approach you in casual clothing wearing red. 

The dilemma with a legal under-achiever is to sue his insurer for failure to carry out your instructions or his failure to give adequate regard to important matters such as historical events, objective conditions or scientific or factual evidence. 

If he has failed to record key events while he was the custodian of your affairs,lost key records,not made proper notes or behaved in a manner which could be viewed as disreputable in any manner for a practising solicitor,not a law graduate simply,then his cause is lost because he will go to prison eventually,not as a visitor but as someone who has perverted the course of justice. A prisoner, therefore, whether he likes it or not.

....In these cases of misfeasance or malfeasance,it is usually a chronic gambler desperate for his next "gambling fix" who has insinuated himself into your or a friend's or parent's acquaintance.

Remember,both solicitor and claimant,no-one is above the law,not George Washington, Bill Clinton,G.W. Bush or anyone else.

The Golden Rule when taking instructions from a client

"If you do not follow a client's instructions strictly and to the letter,he and the Legal Aid Board does not have to pay you and you risk being brought to court yourself since you have a clear conflict of duty and interest. You may even be disqualified from practising law or restrained from any property transactions in your name including selling your house to avoid paying damages to the person who you have wronged."

The only means of gaining redress in Ireland for any reasonably talented individual is to invoke ol' lady law and bring debtors to court. 

Why, so?

Ireland is full of thieves and gamblers who owe those they refer to as 'boss' large sums of money for unpaid labours. Often it is a labour of Sisyphus to bring these crooks to court so the sooner anyone with a modicum of intelligence brings a c... like Gerry Adams and Martin Mc Guinness and "market traders" to court,the better.

One lesson should always be remembered and frequently reiterated by litigant and lawyer.

That is best summed up by the statement, "The lawyer is an officer of the court who is as culpable as policeman or doctor in arrest and false imprisonment and perpetuating glaring miscarriages of justice by dint of personal interest,professional leanings and class affiliation."

He is no fool and if you condemn or insult him,he will take you to the cleaners and bankrupt you for unpaid fees. The task he is given is only a public task. He has no ability or calling to any trade or profession. He is often in fact a whiner and an obstacle to lawful behaviour and the delivery of a settlement be it legal or financial.

Politics and law

Politics plays very little role in regulation of the court system and in Northern Ireland, precious little in influence over our colonial police.

A recommended enactment,a Policing Act...

Many of us believe that we should have some of the police confined to barracks and reporting requirements every ten minutes for others either as individuals or collectively. 

Why? 

To stop them becoming a professional nuisance and a source of stress and annoyance to the public.

 We need a proper political structure for proper debate and sound legislation in Northern Ireland, something sadly absent here and in other European jurisdictions which aspire to be prosperous,law-governed states.

Police defiance of politicians and the laws of the land and the rules of civil government is open and blatant and crude here in our prison state. Police activities are designed to harass and annoy. They emulate the worst excesses of Nazi Germany.

The police recklessly and systematically challenge civil society rules and norms. They often defy the mores and customs of good governance of public affairs. The phenomenon requires tight restrictions on the disruptive activities and bizarre behaviour of the Police Service of Northern Ireland.

My bitter experience of policing and my suggestion learned from experience 

The key to the North's dilemma with roaming gangs of armed policemen is to draw their teeth,namely,take away their guns. According to the normal rules of civil society,people should not be threatened by these people or street combers in the pay of the Home Office and Ministry of Defence. In street scenes, deaf,dumb and blind kids are deployed by police,probation officers,special schools and civil society groups. These hapless innocents have been told they are taking part in a 'play'.

A 'play'?

A 'play' that ends in death or chronic, untreatable insanity as did Tommy O Brien's and Martin Cahill's parlour games on the public paths of Dublin in the 1990's.

 A "minor irritant"( Lenin)? 

No,a major public nuisance in the towns and cities such as Dublin. 

The 'appearance fee'?

 Approximately €5 in the South;in the North,£2.

The response?

Say,"Skat!" or,if you are a trade unionist, say,"Join Equity!".

Which counsels guide their activity?

The colonial legacy is secret courts system summoned by the Secretary of State and operated by judges in chambers in defiance of the Trials and Tribunals Act 1715, the cornerstone of public law.

For the many of us beset by the few acting on the orders of judges in secret courts ('Star Chambers'),those of us unaware of a para-judicial instance,we suffer not knowing accuser or charge.

Some important steps forward could be taken.

Firstly,let us arrest judges and false witnesses and question them as to their whereabouts at certain times.

Second,let us change the Criminal Law Jurisdiction Act 1976 regarding the legal duty to report that a crime has been committed and the requirement to report criminal acts or activity. 

Since the enactment of the Criminal Law Jurisdiction Act,we have steadily developed into a vigilantee society. 

The investigation of crime and TAKING REPORTS OF CRIME IS A POLICE ACTIVITY. The public apart from those immediately concerned should not be under any duty to assist the police.

 Let the police do their own job and stop suborning false witnesses before secret tribunals and courts.

End the coercion of the public.

Another enactment which is badly needed is a Registration of Foreign Agents Act.

Such an act would largely deal with Indian doctors dispatched to the South of England by the Home Office and Foreign and Commonwealth Office to police journalists, writers, artists, musicians and the intelligentsia.
